295.2020 - Notice of Closure

295.2020 requires assisted living providers to provide at least 90 days advance notice of voluntary closure. This includes all or any part of the building that requires termination of residency for any residents in the building. The notice of closure must be provided to:

• The department of public health (IDPH)
• Any resident who is impacted by the termination of residency.
• The resident’s representative
• A member of the resident’s family as practicable.

The notice of closure must include the anticipated date of closure and the reason. The assisted living staff must offer to assist the residents in securing an alternative placement and advise the residents on what options are available to them. When the resident is unable to choose an alternative and does not have a guardian appointment, IDPH shall be notified for assistance in relocation. The provider is expected to comply with all applicable laws until closure.
